Terms and Conditions of Sale

The Somerset Wine Company supplies wine subject to stock remaining on hand. Prices are subject to market fluctuation and we reserve the right to amend prices of goods not already invoiced.

Age Restrictions

Users must be 18 years of age to purchase wine from The Somerset Wine Company website.

Orders and Delivery

Delivery is free to all customers in the Castle Cary/Bruton area. Deliveries further a-field, but still in Somerset will also be free, but orders of less than £50.00 will be carried out as soon as possible when the van is in the relevant area. Delivery to outside of Somerset will be charged at £15.00 regardless of quantity and value. All deliveries will be undertaken either by our own vehicle or by local courier. Advice of non-delivery must be received in writing within 5 days of the invoice date; otherwise The Somerset Wine Company cannot accept claims or responsibility for loss. Goods must be signed for legibly on receipt as either being in good condition or damaged and any such damage advised to us within 3 days.

New Accounts

Accounts requiring credit facilities are kindly requested to fill out a credit account application and supply two trade references. The first order will always be on a pro-forma basis.

Terms

Unless previously arranged credit is limited to £1000. Cash is payable prior to, or upon delivery unless a credit facility has been approved. For credit customers, payment is to be made in full 30 days from invoice date. Interest may be charged at a minimum rate of 5% per month or part thereof on all sums outstanding for the period between the settlement date and the date on which the payment in full is actually received without prejudice to our rights to pursue such outstanding sums at any time after the settlement date.

A charge of £10 plus VAT will be added to every returned cheque or to any bank charges incurred. In the case of repossession an additional £15.00 plus VAT will be added to cover costs in addition to interest charges.

Force Majeure

The Somerset Wine Company shall not be liable for any failure to fulfil any terms of any transaction governed by these conditions of sale if fulfilment has been delayed, hindered or prevented by any circumstances whatsoever which is not directly within their control.

Risk and Title

The goods shall be at the buyers risk from the moment of delivery. All goods remain the property of The Somerset Wine Company until payment in full has been received. Until such payment, the customer shall hold the goods and all items incorporating the goods as trustees for The Somerset Wine Company and must not remove, alter or deface any identification mark placed on the goods or their packaging by us, and shall clearly identify all items incorporating the goods as belonging to The Somerset Wine Company.

In the event of non-payment, The Somerset Wine Company shall be entitled, in addition to other rights, to enter any premises where the goods may be and recover possession of them.

Data Protection Act 1984

To comply with the act, The Somerset Wine Company is required to inform you that they have recorded your name and address on the computer for the sole purpose of sending you their price lists, statements of account and any other information. Your name will not be given to any third party. 

Orders accepted only on customer’s agreement to the above conditions.
